La constitución de la memoria: fundamentos jurídico-políticos para una sociedad en transición

    En este artículo se presenta un análisis de los cambios que ha tenido el desarrollo legal y jurisprudencial de la memoria de cara a los mecanismos de justicia transicional que se han presentado en Colombia. Con ello se logró recopilar la información que permitió evidenciar dichas transformaciones permitiendo establecer una categoría analítica entre un enfoque minimalista y un enfoque maximalista que permita comprender el deber del Estado en los procesos transicionales respecto a la memoria y, por lo tanto, las implicaciones respecto a su objeto de protección y a los sujetos de derecho que busca mediante su cumplimiento alcanzar una paz estable y duradera. En concordancia con esta exposición, el texto logra trazar un marco de relación de las transformaciones jurídico-políticas de los regímenes de memoria en la justicia transicional como cumplimiento del fundamento constitucional de la paz en Colombia.

    This article presents an analysis of the changes that have taken place in the legal and jurisprudential development of memory in the face of the transitional justice mechanisms that have been presented in Colombia. With this, it was possible to compile the information that allowed to evidence such transformations allowing to establish an analytical category between a minimalist approach and a maximalist approach that allows to understand the duty of the State in the transitional processes regarding memory and therefore, the implications regarding its object of protection and the subjects of law that seeks through its fulfillment to achieve a stable and lasting peace. In accordance with this exposition, the text manages to outline a framework of relationship of the legal-political transformations of the regimes of memory in transitional justice as compliance with the constitutional foundation of peace in Colombia.
