Un paso más para la eficacia internacional de la venta forzosa de buques

    El 7 de diciembre de 2022, la Asamblea General de la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional (UNCITRAL) adoptó la conocida como Convención de Beijing sobre la Venta Judicial de Buques, ciudad en la tuvo lugar la firma el 5 de septiembre de 2023. El nuevo convenio supone un paso adelante en el reconocimiento de los efectos internacionales de las ventas forzosas de buques. Para su correcta aplicación el convenio tendrá que aplicarse de manera coherente tanto con las legislaciones nacionales como otros convenios que también se ocupan de esta materia. Este artículo profundiza en la relación entre estos niveles normativos a partir de la regulación española, entre los que existe un alto grado compatibilidad, sin perjuicio de que también serán necesarias algunas reformas.

    On December 7, 2022, the General Assembly of the United Nations Commission on International Trade Law (UNCITRAL) adopted the so-called Beijing Convention on the Judicial Sale of Ships, where it was signed on September 5, 2023. The new convention represents a step forward in the recognition of the international effects of judicial sales of ships. For its correct application, the convention will have to be applied in a manner consistent with both national legislation and other conventions that also deal with this matter. This article explores the relationship between these regulatory levels based on the Spanish regulation, between which there is a high degree of compatibility, without prejudice to the fact that some reforms will also be necessary.
