A vinculação dos poderes do estado à concretização de direitos fundamentais sociais: há espaço para uma margem de apreciação?

    In view of the problems and debates surrounding fundamental social rights, here it is examined notably its multifunctional character and the possibilities of jurisdictional protection, it aims to analyze the feasibility of recognizing a margin of appreciation by the legislator regarding these rights. Therefore, it is questioned whether, given these characteristics and the state’s link to their protection, is there room for a margin of legislative appreciation in the implementation of fundamental social rights? Using deductive method and the bibliographic research technique, through consulta-tion in books, periodicals, jurisprudence and institutional websites, it is possible to con-clude, that the space for legislative decision is not unlimited, since the legislator, like the other State Powers, is linked to the implementation of the fundamental social rights, being the first to guarantee them, legitimizing judicial action in the face of its omission

    Diante das problemáticas e debates que cercam os direitos fundamentais sociais, seu caráter multifuncional e as possibilidades de tutela jurisdicional, objetiva-se, com o presente trabalho, analisar a viabilidade do reconhecimento de uma margem de apreciação do legislador frente a esses direitos. Questiona-se, assim, diante dessas características e da vinculação estatal à sua proteção: há espaço para uma margem de apreciação legislativa na implementação dos direitos fundamentais sociais? Utilizando-se do método dedutivo e da técnica de pesquisa bibliográfica, através da consulta em livros, periódicos, jurisprudência e sites institucionais, é possível concluir que o espaço de decisão legislativa não é ilimitado, estando o legislador, como os demais Poderes Estatais, vinculado à implementação dos direitos fundamentais sociais, sendo ele o primeiro a garanti-los, legitimando, desse modo, a atuação judicial diante de sua omissão.
