Resumen de El elemento subjetivo del injusto en el delito de autoadoctrinamiento terrorista del art. 575.2 cp

  En este trabajo se lleva a cabo un análisis del elemento subjetivo del injusto presente en el delito de autoadoctrinamiento o autocapacitación con fines terroristas. Para ello, después de realizar un breve estudio del tipo objetivo, se efectúa una revisión doctrinal y jurisprudencial del citado elemento subjetivo. Nos hallamos ante un componente teleológico redoblado, que se erige en el aspecto fundamental para determinar la tipicidad de las conductas, y que ha concitado severas críticas.

  Se trata de un delito muy discutido, que confronta con principios esenciales del ordenamiento punitivo y que presenta serias dudas de constitucionalidad, por lo que se propone su derogación y, en su defecto, una interpretación restrictiva, que sea compatible con el respeto a los derechos a la libertad ideológica, religiosa y de conciencia

  In this paper we carry out an analysis of the subjective element of the unjust present in the crime of self- indoctrination or self- training for terrorist purposes. For this, we start making a brief study of the objective type, and we continue with the doctrinal and jurisprudential review of the aforementioned subjective element. We are facing a redoubled teleological component, which stands as the fundamental aspect to determine the typicity of behaviors, and which has attracted severe criticism. This is a much-discussed crime, which conflicts with essential principles of the Spanish punitive system and which presents serious doubts of constitutionality, so we propose its derogation and, failing that, we recommend a restrictive interpretation, which should be compatible with respect for human rights, specially, to ideological, religious and conscience freedom
