Cuestiones controvertidas sobre el uso de tecnologías digitales en el transporte

    El artículo está dedicado a la implementación de tecnologías digitales en el transporte. Hoy en día no se discute la necesidad y ventaja de su uso. Sin embargo, junto al efecto positivo de las tecnologías digitales en el ámbito del transporte, existe la otra cara de la moneda. En primer lugar, es la falta de un enfoque común para la regulación legal de la implementación de tecnologías digitales en diferentes países. Según el análisis, las legislaciones nacionales operan con nociones que en ocasiones no son utilizadas en otras legislaciones o tienen algunas diferencias en el significado. Este enfoque no es apropiado en el transporte internacional ya que crea obstáculos que perturban el transporte mismo. La diferencia se intensifica por el aspecto técnico. Cada país tiene sus propias empresas que elaboran los aspectos técnicos de la implementación de tecnologías digitales. Hoy en día no existe un criterio único para los desarrolladores del software utilizado en los objetos técnicos. Diferentes enfoques en la creación pueden conducir a una situación en la que los objetos inteligentes no pueden reconocerse entre sí y, como resultado, no habrá ninguna conexión e interacción entre los vehículos y la infraestructura misma, que se consideran los objetos centrales de las tecnologías digitales en el transporte.

    En segundo lugar, hay un fenómeno que muestra que, por un lado, la sociedad moderna depende de las tecnologías digitales que han aparecido. Por otro lado, la mayoría de la gente tiene miedo de las nuevas tecnologías porque traen incertidumbre y desconocimiento. Además, las tecnologías digitales en el transporte son un blanco fácil para la violación de los derechos y los intereses de los usuarios. Este problema requiere la consolidación de fuerzas de todos los países para superarlo y proteger a determinadas personas, a la sociedad y al propio Estado de la amenaza creada por la implementación de las tecnologías digitales.

    A pesar de la gran cantidad de artículos escritos en este campo, no existe un enfoque único para la solución del problema. Este hecho hace que el tema de investigación sea actual y digno de atención.

    The article is devoted to the implementation of digital technologies in transportation. Nowadays the necessity and advantage of their use are not argued. However, along with the positive effect of the digital technologies in the sphere of transportation there is the other side of the coin. Firstly, it is the absence of common approach to the legal regulation of implementation of digital technologies in different countries. According to analysis, the national legislations operate with notions that sometimes are not used in other legislations or have some differences in the meaning. Such approach is not appropriate in international transportation as it creates obstacles that disturbs the transportation itself. The difference is intensified by the technical aspect. Each country has its own companies that elaborate the technical issues of the digital technologies implementation. Nowadays there is no single criteria for the developers of the software used in technical objects. Different approaches in the creation can leads to the situation when intelligent objects could not recognize each other and as the result there will be no any connection and interaction between vehicles and infrastructure itself that are deemed to the core objects of digital technologies in transportation.

    Secondly, there is a phenomenon that shows that on the one hand, modern society depend on appeared digital technologies. On the other hand, the majority of people are afraid of new technologies as they bring uncertainty and unknown. Moreover, digital technologies in transportation is the easy target for violation right and interests of users. This problem requires the consolidation of forces of all countries to overcome it and protect certain person, society and the state itself from the threat created by implementation of digital technologies.

    In spite of great amount of articles written in this field, there is no single approach for the solving of the problem. This fact makes the topic of research topical and worth of attention.
