Este trabajo pretende sintetizar los criterios asentados en la jurisprudencia civil sobre el juicio de ponderación entre las libertades de expresión e información y los derechos al honor, a la intimidad personal y familiar, y a la propia imagen, así como señalar los nuevos desafíos que los tribunales han de afrontar ante las nuevas tecnologías y formas de comunicación, por si pudieran obligar a reformular las categorías clásicas y a revisar los límites tradicionales. El trabajo se estructura en dos partes: esta primera parte examina el ámbito de protección de cada uno de los derechos del art. 18.1 de la Constitución y la segunda la dimensión institucional de las libertades de expresión e información y los criterios del juicio de ponderación entre estas libertades y aquellos derechos.

This paper aims to synthesize the criteria established in civil jurisprudence on the balancing of the freedoms of speech and information and the rights to honour, to personal and family privacy, and to one´s own image, as well as to point out the new challenges that the courts have to face in the face of new technologies and forms of communication, in case they might force to reformulate the classic categories and to review the traditional limits. The work is structured in two parts: this first part examines the scope of protection of each of rights in article 18.1 of the Spanish Constitution, and the second part examines the institutional dimension of the freedoms of expression and information and the criteria for weighing these freedoms against those rights.
