En la mayoría de los matrimonios, regidos normalmente por la sociedad de gananciales, la vivienda familiar, debido a su alto coste económico, suele adquirirse mediante una compraventa a plazos, ya se efectúe tal adquisición antes del inicio de la sociedad de gananciales o durante su vigencia. En este trabajo se abordan los problemas fundamentales -la mayoría con un tratamiento muy discutido en la doctrina y en la jurisprudencia- que surgen a causa de la distinta procedencia del dinero (privativo, ganancial o mixto) con que se paga la vivienda, su concepto en la presente sede y otros estrechamente relacionadas.
In the majority of marriages, normally governed by the community property, the family home, due to its high economic cost, is usually acquired through a purchase and sale in installments, whether such acquisition is made before the beginning ofthe community property or during its validity. This work addresses the fundamental problems -most of them with a highly discussed treatment in doctrine and jurisprudence- that arise due to the different origin ofthe money (prívate, community or mixed) with which housing is paid, its concept at the present headquarters and others closely related.
