This study analyzes the mortis causa destination ofthe vacant portion left by the beneficiary when he/she predeceases or repudiates the inheritance. In such cases it is necessary to distinguish perfectly whether we are dealing with a vulgar substitution, or whether the rules on the right of representation or the right of accretion apply. The consequences of repudiation of the inheritance are also examined in those cases in which there may be a concurrent application ofthe rules on the transfer of "ius delationis".

En este estudio se analiza el destino mortis causa que puede tener la porción vacante que deja el instituido cuando fallece antes que el causante o repudia la herencia. En tales casos es preciso deslindar perfectamente si estarnos ante una sustitución vulgar o si se aplican las normas sobre el derecho de representación o el derecho de acrecer. Se examinan, además, las consecuencias que tiene la repudiación de la herencia en aquellos casos en que puede existir una aplicación concurrente de las normas sobre transmisión del "ius delationis".
