  A raíz de las revoluciones de libertad, nació el poder constituyente que dio origen a la norma fundamental de los Estados. Desde aquella época hasta la actualidad, en múltiples ocasiones se ha invocado el poder constituyente como herramienta del pueblo para hacer nacer una nueva Constitución. Sin embargo, a través del tiempo, han surgido varios límites al poder constituyente de forma que pueda, en sí mismo, proteger a los ciudadanos actuales y futuros con respecto a los derechos que se reconocerán y la nueva estructura estatal que se creará. En este ensayo, se detallan y explican cada uno de los límites del poder constituyente, así como aquellos que se invocaron y los que no se aplicaron en última experiencia ecuatoriana de reforma constitucional del año 2007.

  The first constitutions were birthed by constituent powers brought on by the American and French revolutions. From that time, up til now the constituent powers has been used to rewrite old constitutions and create new ones. However throughout time, limits have been set for this type of constituent power in order to protect citizens’ rights. In this essay we detail each and every one of the limits set by the constituent power, using the example of the constitutional reform of Ecuador in 2007.
