Resumen de Cambios en el sistema de tenencia de la tierra entre fines del periodo colonial y los inicios del republicano: los efectos de los decretos de Bolívar en Huacho

Este estudio de caso busca analizar el efecto que produjo en el pueblo de Huacho el paso del tradicional reparto de tierras a los indígenas, ligado al pago del tributo, al proceso de privatización de las tierras de las comunidades como consecuencia de los decretos de Bolívar en 1824 y 1825, reafirmados por la Ley dada por el Congreso Constituyente en 1828, y si este reparto fue utilizado por fidelistas e insurgentes como estrategia para conseguir la fidelidad de los indígenas durante el proceso de independencia. Se inicia con un repaso de cómo se llevaba a cabo el reparto de tierras a fines de la colonia, para luego analizar la normatividad dada sobre la materia entre 1824 y 1828, con el fin de contextualizarlos y evaluar su impacto. Las fuentes primarias utilizadas son documentos judiciales, notariales y de juzgado de paz que se conservan el Archivo Regional de Lima.

This case study seeks to analyze the effect produced in the town of Huacho the passage of the traditional distribution of land to the indigenous, linked to the payment of tribute, To the process of privatization of the lands of the communities as a result of the decrees of Bolivar in 1824 and 1825, reaffirmed by the Law given by the Constituent Congress in 1828, and if this distribution was used by fidelistas and insurgents as a strategy to achieve the fidelity of the indigenous during the process of independence. It begins with a review of how the land distribution was carried out at the end of the colony, and then analyze the regulations given on the matter between 1824 and 1828, in order to contextualize them and evaluate their impact. The primary sources used are judicial, notarial and peace court documents that are preserved in the Regional Archive of Lima.
