El presente trabajo discute que, en el proceso de construcción del estado nacional, la forma como el régimen federal, consagrado en la Constitución Nacional, entendió la relación entre jurisdicción y territorio se proyectó en las normas constitucionales referidas a la sanción de los códigos y su aplicación. A partir de una perspectiva ius historiográfica se examinará las normas y debates parlamentarios y doctrinarios que generó la reserva establecida por el artículo 67, inciso 11 de la Constitución Nacional. Finalmente, se indagará cómo la Corte Suprema de Justicia de la Nación comprendió dicha reserva y las vías que instrumentó para superarla.

This paper discusses that, in the process of building the national state, the way in which the federal regime, enshrined in the National Constitution, understood the relationship between jurisdiction and territory was projected in the constitutional norms referred to the sanction and application of the codes. From an iushistoriographical perspective, we will examine the norms and parliamentary and doctrinal debates thatgenerated the legal reserve established by article 67, paragraph 11 of the National Constitution. Finally, it will examine how the Supreme Court of Justice of the Nation understood this article and the ways it implemented to overcome it
