Resumen de La guerra contra el terrorismo: la agenda política de un presidente que se convirtió en una transgresión del derecho internacional

  Los atentados terroristas ocurridos el 11 de septiembre de 2001 marcaron un hito mundial en donde Estados Unidos de América y el derecho internacional reaccionaron con una serie de iniciativas políticas y legislativas para contrarrestarlo. Este artículo de reflexión tiene como objeto exponer la forma en que Estados Unidos ha reaccionado al terrorismo en el marco del derecho internacional y el derecho internacional humanitario. Para ello se examinará la agenda política del expresidente George W. Bush al iniciar la guerra contra el terrorismo, tras los atentados del 2001, y se hará un análisis histórico-jurídico de las medidas tomadas por Estados Unidos desde el 2001 hasta hoy. Al final, se concluye que el derecho internacional humanitario parece frágil, ya que al parecer no existe un mecanismo legal efectivo que garantice su coercibilidad.

  The terrorist acts that occurred on September 11 of 2001 were a critical moment in history, in which the United States of America and International Law reacted with a series of political and legislative initiatives to counteract against them. This comment presents the main characteristics of the response of the United States to terrorist acts in the context of International Law and International Humanitarian Law. To do so, this article provides an analysis of the political and legal agenda of former U.S. president George W. Bush, particularly the war on terror that occurred after the events of 2001. To achieve this, the document will present a historic and legal examination of the measures adopted by the United States of America since 2001 until today. It is concluded that International Humanitarian Law may seem weak because in case of violations on the part of different actors, there is no “apparent” effective international legal mechanism to guarantee its proper enforcement.
