  Las constituciones expresan la naturaleza política de las sociedades que se organizan bajo un ordenamiento jurídico. Y los preámbulos son la primera voz de esa organización. Contrasta, sin embargo, la gran importancia que supone la expresión inicial del poder constituyente, con la poca claridad que hay sobre (i) la naturaleza jurídica del contenido de los preámbulos constitucionales en general, (ii) la función de estos y (iii) su fuerza vinculante. Este escrito pretende, pues, resolver los puntos mencionados a partir de la doctrina nacional e internacional aplicable y de la teoría del derecho. El texto, además, aplica sus conclusiones teóricas al caso del preámbulo de la Constitución de Colombia de 1991, teniendo en cuenta la jurisprudencia constitucional y los apuntes de la doctrina local sobre la materia.

  Constitutions express the political nature of societies that are orga nized under a legal system. Preambles represent the first voice in such organizations. However, the great relevance of the initial ex pression of the constituent power contrasts with the lack of clarity on (i) the legal nature of the content of constitutional preambles in general, (ii) their function and (iii) their legal binding force. This text thus seeks to address the aforementioned points on the basis of legal theory and the relevant national and international legal literature. Furthermore, the text applies its theoretical conclusions to the case of the preamble of the Colombian Constitution of 1991, taking into account the constitutional jurisprudence and the local doctrine on the matter.
