La evolución del arbitraje ha llegado a un punto de no retorno. Cada vez se confía menos en las instituciones arbitrales, y el arbitraje de consumo no acaba de despegar. La huida de la jurisdicción –o su privatización–, por tanto, no se ha acabado de consumar si no es forzando el recurso a la mediación. En el presente trabajo se ofrecen propuestas para mejorar lo que más ha fallado: la imparcialidad de los árbitros. En este sentido, se abre la puerta ante un futuro en que el arbitraje online y anónimo debiera ser la regla. La asistencia de la inteligencia artificial debería ayudar a recuperar una de las más importantes funciones históricas del arbitraje que quedó en el olvido: su función restaurativa.

The evolution of arbitration has reached a point of no return. There is less and less trust in arbitration institutions, and consumer arbitration has not taken off. The flight from jurisdiction -or its privatisation-, therefore, has not been completed except by forcing mediation. This paper offers proposals to improve what has failed the most: the impartiality of arbitrators. In this sense, it opens the door to a future in which online and anonymous arbitration should be the rule. The assistance of artificial intelligence should help to recover one of the most important historical functions of arbitration that has been forgotten: its restorative function.
