La justicia de proximidad en el umbral del cambio: la disyuntiva entre los Juzgados de Paz y las Oficinas de Justicia en los Municipios

    Los Juzgados de Paz constituyen la base de la jurisdicción en España y son, en muchos casos, el primer punto de contacto entre la ciudadanía y el Poder Judicial. Sus funciones, actualmente escasas, se centran en la resolución de conflictos de poca gravedad, a veces por vía procesal y otras a través de la conciliación, así como en la realización de actos de auxilio judicial. Su función social es importante en cuanto extienden el Poder Judicial a todo el territorio nacional y además están destinados a mantener la paz en los municipios en donde ejercen su jurisdicción. No obstante, estos órganos judiciales han sido objeto de críticas ya que están servidos por jueces legos en Derecho, por su sistema de nombramiento y la vinculación que guardan con los Ayuntamientos locales -de manera que se ha puesto en duda su independencia- y por la falta de medios materiales y humanos que llega a dificultar su adecuada gestión y desempeño. Partiendo de la creencia de que el modelo de Justicia de Paz actual ha dejado de ser útil o, al menos, eficiente, se ha planteado su reforma en el Proyecto de Ley Orgánica de eficiencia organizativa del servicio público de Justicia, la cual implicaría la desaparición de los actuales Juzgados de Paz y su transformación en Oficinas (administrativas) de Justicia en los municipios. En este artículo estudiamos la configuración de los Juzgados de Paz, así como la reforma propuesta, para destacar cuáles son las posibles ventajas y desventajas de cada uno de estos modelos y así analizar cuál podría ser la mejor alternativa para configurar el sistema de justicia municipal, de manera que se garantice al justiciable el derecho fundamental a una tutela judicial que sea efectiva y, al mismo tiempo, eficiente.

    The Magistrates' Courts are the base of the Spanish judiciary and, in many cases, are the first point of contact between citizens and the Courts of Justice. Their functions, which are currently scarce, are centered on the resolution of minor conflicts, sometimes by procedural means and sometimes through conciliation, as well as on carrying out acts of judicial assistance. Their social function is important because they extend the judiciary to the whole of the national territory and are also intended to maintain peace in the municipalities where they exercise their jurisdiction. However, these judicial bodies have been criticized because they are run by judges who are not experts in law, because of their appointment system and the link they have with the local town councils -so their independence has been called into question- and because of the lack of material and human resources, which hampers their proper management and performance. Believing that the current model of Justice of the Peace has ceased to be useful or, at least, efficient, its reform has been proposed in the Bill on Organizational Efficiency of the Public justice Service, which would imply the disappearance of the current Magistrates' Courts and their transformation into (administrative) Municipal Justice Offices. In this article we study the current configuration of the Spanish Magistrates' Courts, as well as the proposed reform, in order to highlight the possible advantages and disadvantages of each of these models and thus analyze which could be the best alternative for shaping the municipal justice system in a way that guarantees the fundamental right to effective and, at the same time, efficient judicial protection.
