Resumen de El nuevo constitucionalismo latinoamericano, presidencialismo y revocatoria del mandato

América Latina, un continente que ha pasado de una senda historia constitucional antidemocrática, que a finales del Siglo XX y principios del Siglo XXI, ha propendido por generar constituciones democráticas, siendo Colombia, Venezuela, Ecuador y Bolivia los abanderados de este modelo que manteniendo su bicentenaria tradición presidencialista, se ha preocupado por tratar de controlar el desbordado presidencialismo (hiperpresidencialismo) y en consecuencia tratar de mantener el sistema de frenos y contrapesos, en el presente artículo, revisaremos uno de esos mecanismos como lo es la Revocatoria Directa, mirando la figura desde un punto de vista doctrinario siendo una investigación jurídica, revisando el tema de la mano con aspectos propuestos por los mismos gobiernos, la rama legislativa y los pronunciamientos de los tribunales constitucionales, evidenciando los problemas que en la práctica evidencia este mecanismo de participación democrática y como este afecta el ejercicio democrático.

Latin America, a continent that has gone from an anti-democratic constitutional history, which at the end of the 20th century and beginning of the 21st century, has tended to generate democratic constitutions, with Colombia, Venezuela, Ecuador and Bolivia being the standard bearers of this model that maintains its bicentennial presidential tradition, has been concerned with trying to control the overflowing presidentialism (hyperpresidentialism) and consequently trying to maintain the system of checks and balances, in this article, we will review one of those mechanisms such as Direct Revocation, looking at the figure from a doctrinal point of view, being a legal investigation, reviewing the topic hand in hand with aspects proposed by the governments themselves, the legislative branch and the pronouncements of the constitutional courts, evidencing the problems that this mechanism of democratic participation shows in practice and how this affects the democratic exercise.
