La Jurisprudencia de la Sala Constitucional del TSJ ha “creado” un mecanismo para controlar la “constitucionalidad y convencionalidad” de las decisiones de la CIDH. Se trata de un mecanismo no previsto en la Constitución y no previsto en la Convención Americana sobre Derechos Humanos. Se trata de un control cuyo proceso de creación es – desde la Constitución Venezolana – cuestionable. Se trata además de un mecanismo que supone la infracción de normas y derechos previstos en la Constitución. Se trata además de un mecanismo que supone una subversión de los compromisos internacionales asumidos por la República y una infracción a normas y principios de la Convención Americana sobre Derechos Humanos.
The Jurisprudence of the Constitutional Chamber of the TSJ has “created” a mechanism to control the “constitutionality and conventionality” of the decisions of the CIDH. It is a mechanism not provided for in the Constitution and not provided for in the American Convention on Human Rights. This is a control whose process of creation is - from the Venezuelan Constitution - questionable.
