Resumen de La jurisprudencia del horror: las posturas argumentales de la Sala Constitucional ante el tema constituyente (marzo-mayo 2017)

La Justicia Constitucional venezolana luego del segundo trimestre de 2017, preparó el camino para la concreción de una Asamblea Nacional Constituyente contra todo sentido lógico, jurídico y político. A través del mecanismo de las sentencias de gobierno, facilitó al Ejecutivo Nacional la imposición de una asamblea con funciones constituyentes no reconocida ni en el texto constitucional de 1999, ni mucho menos en los principios del constitucionalismo contemporáneo.
Asume así la Sala Constitucional, la misma postura que los juristas europeos que justificaron errores históricos del fascismo, como es el caso de las leyes fundamentales del Reino (España), las leyes fascistas (Italia) y por supuesto el Derecho del horror de la Alemania Nazi. Pretendemos con este artículo, realizar un recuento argumental de lo ocurrido en las decenas de sentencias que allanaron el camino para la Asamblea Nacional Constituyente de 2017.

The Venezuelan Constitutional Justice after the second quarter of 2017, prepared the way for the concretion of a National Constituent Assembly against all logical, legal and political sense. Through the mechanism of government rulings, it facilitated to the National Executive the imposition of an assembly with constituent functions not recognized neither in the constitutional text of 1999, much less in the principles of contemporary constitutionalism. Thus assumes the Constitutional Chamber, the same position as the European jurists who justified historical errors of fascism, as is the case of the fundamental laws of the Kingdom (Spain), fascist laws (Italy) and of course the law of horror of Germany Nazi. With this article, we intend to carry out a plot of what happened in the dozens of sentences that paved the way for the 2017 National Constituent Assembly.
