La figura del juez español contemporáneo está llena de facetas que vienen determinadas mayoritariamente por un buen número de disposiciones infralegales y, sobre todo, por la Ley provisional sobre organización del poder judicial de 1870. Durante los siglos xix y xx prevaleció la figura del juez-funcionario dependiente del Ministerio de Justicia, al que correspondía fijar su estatuto y concretar su aplicación. Su función constitucional y legal fue aplicar la ley, juzgando y haciendo ejecutar lo juzgado con sujeción al imperio de la ley, pero no exclusivamente, pues la doctrina legal emanada del Tribunal Supremo se impuso como elemento clave para su aplicación por parte de los jueces.

The figure of the contemporary Spanish judge is full of facets that are mainly determined by a good number of sub-legal provisions and, above all, by the Provisional Law on the Judicial Branch of 1870. During the 19th and 20th centuries, the figure of the judge-official dependent on the Ministry of Justice, which was responsible for establishing its statute and specifying its application. Its constitutional and legal function was to apply the law, judging and having executed what was judged, subject to the rule of law, but not exclusively, since the legal doctrine emanating from the Supreme Court was imposed as a key element for its application by the judges.
