La vulneración al principio del doble conforme en las contravenciones de tránsito que no impliquen a la privación de la libertad

    El derecho a recurrir, es una garantía procesal consagrada en la constitución ecuatoriana y en diversos instrumentos jurídicos internacionales, a pesar de esto existen una falta de garantía dentro de la aplicación de casos donde no existe privación de libertad en contravenciones de tránsito. El objetivo es determinar el grado de cumplimiento por parte de la normativa infra constitucional ecuatoriana del derecho a recurrir en este tipo de sentencias. La investigación fue de tipo mixta con énfasis en lo cualitativo, se aplicaron métodos como en inductivo- deductivo, histórico-lógico y analítico-sintético. Como resultado se estableció la violación del Derecho Humano a recurrir, ante las sentencias en contravenciones de tránsito donde no implica privación de libertad, generando indefensión y descontento en la administración de justicia. Como aporte se estableció la necesidad de una reforma al art. 644. 6 del Código Orgánico Integral Penal, que garantice lo dispuesto en la carta magna ecuatoriana.

    The right to appeal is a procedural guarantee enshrined in the Ecuadorian constitution and in various international legal instruments, despite this there is a lack of guarantee within the application of cases where there is no deprivation of liberty in traffic violations. The objective is to determine the degree of compliance by the Ecuadorian infra-constitutional regulations of the right to appeal in this type of sentence. The research was of a mixed type with emphasis on the qualitative, methods such as inductive-deductive, historical-logical, analytical-synthetic were applied. As a result, the violation of the Human Right to appeal was established, before the sentences in traffic violations that do not imply deprivation of liberty, generating defenselessness and discontent in the administration of justice. As a contribution, the need for a reform to art. 644.

    6 of the Comprehensive Organic Criminal Code, which guarantees the provisions of the Ecuadorian Magna Carta.
