Reflexiones sobre el bien jurídico protegido en el delito de administración desleal

    Tras la reforma de la LO 1/2015 de 30 de marzo que derogó el articulo 295 CP regulando el nuevo delito de administración desleal en el artículo 252 CP, es de vital importancia determinar el bien jurídico que se protege en el mismo; si se trata del patrimonio en sí mismo o de la fidelidad entre el administrador y el titular del patrimonio administrado. El estudio de las distintas Teorías existentes sobre el fundamento de la protección jurídico-penal del patrimonio (Teoría jurídica; Teoría económica; Teoría mixta, y Teoría personal), nos ha llevado a considerar, que el fundamento esencial de la protección jurídico-penal del patrimonio está en preservar el poder de disposición de una persona sobre los bienes económicamente transables de su patrimonio, protegidos por el derecho.

    “Following the reform of LO 1/2015 of March 30, which repealed article 295 CP, regulating the new crime of unfair administration in article 252 CP, it is vitally important to determine the legal good that is protected therein, whether it is about the assets themselves or the fidelity between the administrator and the owner of the managed assets. The study of the different existing Theories on the foundation of the legal-criminal protection of heritage (Legal Theory; Economic Theory; Mixed Theory, and Personal Theory), has led us to consider that the essential foundation of the legal-criminal protection of the Heritage is about preserving a person’s power of disposal over the economically tradable assets of their heritage, protected by law.
