    How can the pacifying virtues of the law implemented by political institutions prevent civil war and the tearing apart of the social pact it inevitably causes? Civil war—a “non-international armed conflict”, according to the definition of international humanitarian law—is always a failure. The failure of the human community within a state to live peacefully together; the failure of the government (as defined by international law) to propose an inclusive social project based on shared values; the failure of constitutional mechanisms to allow the non-violent expression of utopian protest. Preventing civil war implies first anticipating the occurrence of belligerent factors through a decisive public action in all the domains of society (education, justice, elections, etc.). It also means preparing for it at the operational level, i.e. deploying from the early stages of armed struggle an adequate multidimensional answer in order to avoid the collapse of social cohesion.

    Comment les vertus pacificatrices du droit, mis en œuvre par les institutions publiques, peuvent-elles prévenir la guerre civile et le déchirement du pacte social qu’elle cause inévitablement ? La guerre civile – ce « conflit armé non international », selon la qualification du droit international humanitaire – est toujours une défaite : celle de la communauté humaine d’un État à vivre ensemble de manière paisible ; celle du gouvernement (au sens que lui donne le droit international) à proposer un projet social inclusif, fondé sur des valeurs partagées ; celle des mécanismes constitutionnels à permettre l’expression non violente de la contestation utopique. Prévenir la guerre civile, c’est d’abord anticiper la survenance des facteurs belligènes, par une action publique résolue dans tous les domaines de la société (éducation, justice, élections, etc.). Mais c’est aussi s’y préparer, sur le plan opérationnel, de manière à déployer, dès les prémices de la lutte armée, une réponse multidimensionnelle adéquate permettant d’éviter l’effondrement de la cohésion sociale.
