Este artículo desarrolla, bajo el sistema constitucional venezolano, la inconstitucionalidad de la extinción y caducidad legal que opera contra las acciones y reclamos contra el silencio administrativo negativo. El actual modelo venezolano es constitucionalmente incoherente, por cuanto la Administración Pública conserva sin límites temporales la obligación de responder y al mismo tiempo los ciudadanos no pueden exigir judicialmente esa obligación después de haber ocurrido la caducidad.
This paper examines the unconstitutionality of the statute of limitations applicable to claims in case of administrative silence or inaction of the Public Administration under Venezuelan Constitutional Law. After the statutory time to issue an administrative adjudication has run the citizen could file an action or administrative claim against this inaction, equivalent only for this purpose to an order denying relief. The existing model is constitutionally incoherent because although agencies have the constitutional duty to respond to administrative petitions without time limits, at the same time petitioners cannot enforce such a duty once the statute of limitations has elapsed.
