    La nueva redacción del artículo 94 del Código Civil ha sido discutida hasta el punto de cuestionarse su constitucionalidad. Pese a haberse declarado constitucional, cabe plantearse si el texto actual del precepto satisface el interés superior del menor, así como si la interpretación del mismo realizada por la referida sentencia del Tribunal Constitucional, negando el automatismo, nos lleva al punto de partida, resultando, así, innecesaria la modificación llevada a cabo, al otorgarse actualmente a los casos de violencia doméstica y de género un trato similar al existente antes de la reforma.

    The new wording of article 94 of the Civil Code has been discussed to the point of questioning its constitutionality. Despite having been declared constitutional, it is worth considering whether the current text of the provision satisfies the best interests of the minor, as well as whether the interpretation of the same made by the aforementioned ruling of the Constitutional Court, denying automatism, takes us to the starting point, resulting, Thus, the modification carried out is unnecessary because cases of domestic and gender violence are currently given treatment similar to that existing before the reform.
