El despido colectivo de hecho y las bajas voluntarias incentivadas: un paso decisivo. Comentario a la STS 3812/2023, de 19 de septiembre

    La obligación de computar las extinciones de mutuo acuerdo, cuando se producen a iniciativa del empresario y en un marco de reestructuración de plantilla, para determinar los umbrales del despido colectivo, supondrá un cambio muy relevante en la actuación de las empresas, que ya no podrán acudir de manera generalizada al mecanismo de bajas voluntarias incentivadas para eludir el procedimiento legal de despido colectivo y la participación de los representantes de los trabajadores en el preceptivo periodo de negociación y consultas.

    The obligation to take into account mutually agreed terminations, when they occur at the employer’s initiative and within the framework of a restructuring of the workforce, to determine the thresholds for collective dismissal, will represent a very significant change in the actions of companies, which will no longer be able to resort in a generalized manner to the mechanism of voluntary dismissals to avoid the legal procedure of collective dismissal and the participation of the workers’ representatives in the mandatory period of negotiation and consultation.
