  El aumento del recurso al teletrabajo en los últimos años ha puesto en evidencia muchas de sus carencias reguladoras. Una de ellas guarda relación con el concepto de accidente de trabajo. La LTD no incorporó ninguna referencia sobre esta cuestión, y tampoco se ha modificado el artículo 156 de la LGSS para adaptar su contenido a las especialidades del teletrabajo. Esta falta de adaptación normativa ha llevado a los tribunales a tener que aplicar la normativa y jurisprudencia clásicas a esta nueva forma de prestación de servicios. Esta tarea, en cambio, no está siendo sencilla y encontramos pronunciamientos divergentes que, en el futuro, podría tener que resolver el Tribunal Supremo. En este trabajo, se analizan estos problemas aplicativos y las soluciones judiciales que se están produciendo en la materia, tratando de aportar soluciones interpretativas que ayuden a proteger, en condiciones de igualdad, a las personas teletrabajadoras.

  The increase in the use of remote working in recent years has highlighted many of its regulatory shortcomings. One of these relates to the concept of accidents at work. The LTD did not incorporate any reference to this issue, and Article 156 of the LGSS has not been modified to adapt its content to the specifics of remote working. This lack of regulatory adaptation has led the courts to apply the classic regulations and jurisprudence to this new form of service provision. This task, on the other hand, is not proving simple and we find diverging sentences that the Supreme Court may have to resolve in the future. In this exercise, these application problems and the judicial solutions that are being produced on the matter are analysed, while trying to provide interpretative solutions that help to protect remote workers with an equal footing.
