Las obligaciones de información y asesoramiento impuestas a los distribuidores de seguros, sobre todo en fase precontractual, constituyen el núcleo central de la regulación actual del mercado asegurador para lograr una efectiva protección de los clientes de seguros. El tiempo transcurrido desde la aprobación de las Directivas comunitarias de Solvencia II y Distribución de Seguros y el proceso de revisión y actualización en que ambas normas están incursas, hacen de este el momento oportuno para valorar si la regulación de estas obligaciones precontractuales ha generado el efecto tuitivo buscado. Por otro lado, la creciente digitalización de la industria aseguradora está cambiando la forma de comercializar y distribuir seguros. Herramientas como el big data y la inteligencia artificial hacen posible que puedan cumplirse las obligaciones de información y asesoramiento de manera automatizada, sin intervención humana o con muy escasa presencia de los distribuidores. Por ello, es también el momento de reflexionar sobre cómo encaja en la legislación vigente la utilización de herramientas como los chatbots o roboadvisor, así como sobre la oportunidad de que las futuras reformas legislativas den respuesta a las nuevas necesidades de protección de los clientes de seguros.
The information and advisory obligations imposed on insurance distributors, especially in the pre-contractual phase, constitute the core of the current regulation of the insurance market to achieve effective protection of insurance clients. The time elapsed since the approval of the Community Directives on Solvency II and Insurance Distribution, and the review and update process in which both standards are involved, make this an opportune moment to assess whether the regulation of these pre-contractual obligations has generated the desired protective effect. On the other hand, the increasing digitization of the insurance industry is changing the way insurance is marketed and distributed. Tools such as big data and artifi cial intelligence make it possible to fulfi ll information and advisory obligations in an automated manner, without human intervention or with very little involvement from distributors. Therefore, it is also a time to refl ect on how the use of tools such as chatbots or robo-advisors fits into current legislation, as well as the opportunity for future legislative reforms to address the new protection needs of insurance clients.
