Algunas estrategias argumentativas para superar problemas de interpretación jurídica

    Este artículo tiene como propósito analizar algunas estrategias argumentativas empleadas por la doctrina y poner de manifiesto que no se limitan a describir y sistematizar el derecho positivo, sino que realizan una función reconstructiva de los defectos lógicos y formales que presenta la legislación, en particular se utilizan para identificar, para prevenir, para suscitar y/o para intentar resolver problemas de interpretación; aunque, en realidad, ellas no siempre logran solucionarlos, sino que más bien corresponden a operaciones implícitas de decisión, valoración y justificación que inevitablemente están presentes en la interpretación y aplicación del derecho. Algunas de esas estrategias corresponden a la identificación de naturalezas jurídicas, la enunciación de definiciones y el uso de determinadas denominaciones.

    The purpose of this article is to analyze some argumentative strategies used by the doctrine and to show that they are not limited to describing and systematizing positive law, but rather perform a reconstructive function of the logical and formal defects that legislation presents, in particular they are used to identify, to prevent, to raise and/or to try to solve problems of interpretation, although in reality, they do not always manage to solve them, but rather they correspond to implicit operations of decision, evaluation and justification that are inevitably present in the interpretation and application of the law. Some of these strategies correspond to the identification of legal natures, the enunciation of definitions and the use of certain denominations.
