    El artículo a disposición del lector pretende analizar un conjunto de hechos jurídicos de índole tributaria que, en su conjunto, provocan sobre el contribuyente un efecto confiscatorio. La contratación de bienes y servicios por parte del Estado ecuatoriano constituye el hecho generador de una serie de obligaciones tributarias que se tornan inmediatamente exigibles. Empero, ¿qué ocurre cuando el Estado incumple sus obligaciones de pago y a ello le suma el cobro forzoso de las obligaciones tributarias generadas? El efecto compromisorio sobre patrimonio del contratista —y ejecutado— se torna evidente, cayendo en la esfera de la confiscación. Como verá el lector, no existe una vía eficaz para la compensación de créditos, así como a posibles discrecionalidades desmedidas en el proceso de ejecución.

    The article at the disposal of the reader intends to analyze a set of legal facts of tributary scope that provoke a confiscatory effect on the taxpayer. The contracting of goods and services by the Ecuadorian State constitutes the source of a set of tributary obligations that become immediately enforceable. However, what happens when the State fails to comply with its payment obligations, and this is compounded by the forced collection of the tax obligations generated? The compromising effect on the assets of the contractor -and executed- becomes evident, falling into the sphere of confiscation. As the reader will see, there is no effective way for the compensation of credits, as well as possible excessive discretionalities in the execution process.
