Breve digresión, a propósito de la Ley 17/2021 sobre el régimen jurídico de los animales, sobre el camino hacia la modernización del Código Civil

    El presente trabajo describe la motivación –por su contenido- y el procedimiento de elaboración de la iniciativa legislativa, mediante proposición de ley de varios grupos políticos del Congreso y subsiguiente tramitación en la Cortes Generales de la Ley 17/2021, cuyo análisis es el objeto del presente Nº 10, monográfico, de esta Revista, a efectos de proporcionar los elementos necesarios para comparar los mismos, con la motivación y los procedimientos que han sido utilizados en reformas recientes del Código Civil, así como otras que están siendo tramitadas en la presente XIV Legislatura y las que están por venir. Este análisis pone de relieve la dificultad de afrontar reformas técnicamente complejas de nuestro Código Civil, particularmente cuando, por su profundidad y alcance, tienen gran calado. La delegación legislativa para la aprobación de textos articulados puede ser el instrumento idóneo para acometer este reto, que, dada la necesidad de adecuar el Código Civil a los cambios sociales, no debe abandonarse.

    This work describes the motives –based on content- and the procedure followed for its introduction -through a bill introduced by representatives of parliamentary groups of political parties and subsequent discussion and enactment by the Cortes Generales [the Spanish Parliament] of Act 17/2021, the analysis of which is the subject addressed by the current volume 10 of the Journal, in order to provide the adequate elements needed to compare them with the motivations and procedures adopted in other recent amendments of the Spanish Civil Code, as well as in others that are been considered by Parliament for amendment in this 14th Legislature, and bills that will follow soon. This analysis highlights the difficulty of facing technically complex reforms of the Spanish Civil Code, particularly when, due to their depth and scope, they have great depth. The legislative delegation for the approval of articulated texts may be the ideal instrument to undertake this challenge, which, given the need to adapt the Civil Code to social changes, should not be abandoned.
