En los últimos meses, los medios de comunicación y algunos sectores de la judicatura han puesto de manifiesto que la Administración de Justicia está experimentando una convulsión preocupante, cercana al colapso. Los niveles de litigiosidad se han incrementado notablemente, el calendario de las vistas y señalamientos es desesperante para las partes y los agentes jurídicos intervinientes, los funcionarios judiciales han experimentado cotas de trabajo superiores a los límites ordinarios. Las huelgas, paros y manifestaciones de los últimos meses —por parte de jueces, letrados de la administración de justicia, funcionarios y otros agentes como abogados y procuradores— parece venir a agravar los males endémicos que padece el sistema.
Este trabajo, de base fundamentalmente empírica, tiene por objeto analizar la situación por la que atraviesa el sistema judicial y determinar si la mediación podría suponer una vía de solución a muchos de los problemas que padece. La investigación toma como punto de partida el análisis de los datos estadísticos relativos a las variables de: lentitud, congestión y litigiosidad, así como los referentes a la mediación intrajudicial, publicados por diferentes organismos oficiales, esbozándose el escenario en el que se desenvuelve la justicia española. Una de las variables que se analiza es si la mediación intrajudicial está siendo actualmente efectiva, cuestionándose la necesidad de una apuesta firme y decidida por parte del legislador para paliar las consecuencias derivadas de los altos índices de litigiosidad, lentitud y congestión. El problema (como siempre) está en cómo afrontar de forma decidida los problemas padecidos por el sistema, teniendo en cuenta el principio de voluntariedad de la mediación. Quizás, sea necesario confirmar, como requisito de procedibilidad, el recurso a la mediación en determinados asuntos civiles y mercantiles.

In recent months, the media and some sectors of the judiciary have shown that the Administration of Justice is experiencing a worrying upheaval, close to collapse. The levels of litigation have increased remarkably, the calendar of views and signalling is desperate for the parties and legal agents involved. Court officials have experienced workloads beyond the ordinary limits. Strikes, work stoppages and demonstrations in recent months —by judges, court clerks, civil servants and other actors such as lawyers and solicitors— have aggravated the endemic ills of the system.
This work is fundamentally empirically based and aims to analyse the situation of the judicial system and to determine whether mediation could be a solution to many of the problems it suffers from. The research takes as its starting point the analysis of statistical data relating to the variables of: slowness, congestion and litigiousness, as well as those referring to intra-judicial mediation, published by different official bodies, outlining the scenario in which the Spanish justice system operates. One of the variables analysed is whether intra-judicial mediation is currently effective, questioning the need for a firm and decisive commitment on the part of the legislator to alleviate the consequences of the high rates of litigation, slowness and congestion. As a final reflection, the problem (as always) lies in how to tackle it, considering the principle of voluntariness and the deficient training (or rather «education») of citizens in terms of values such as conciliation and empathy with others. Are we really talking about problems in the judicial system or rather about education?
