Resumen de La vulneración de la dignidad de la persona humana y los derechos fundamentales en España durante el estado de alarma

El presente trabajo de investigación tiene como objetivo principal el estudio tanto en el marco constitucional, como su regulación en distintas normativas de la vulneración de la dignidad de la persona humana y de los derechos fundamentales durante el estado de alarma en España, declarado el 14 de marzo del 2020 mediante la promulgación del Real Decreto 463/2020, como gestión para poder hacer frente a la crisis sanitaria que estaba aconteciendo en el país debido a la pandemia mundial provocada por el Covid-19. Asimismo, se analizan las diferencias del estado de alarma con el estado de excepción y sitio, así como también las consecuencias del estado de alarma y sus prórrogas a nivel jurídico. Por último, se hace una distinción entre limitación, suspensión y prohibición, así como también se analiza la afectación que han provocado las restricciones y las posibles limitaciones en los derechos fundamentales recogidos en nuestra Constitución.

The main objective of this research work is the study both in the constitutional framework, and its regulation in different regulations of the violation of the dignity of the human person and fundamental rights during the state of alarm in Spain, declared on March 14, 2020 through the promulgation of Royal Decree 463/2020, as management to be able to face the health crisis that was happening in the country due to the global pandemic caused by Covid-19. Likewise, the differences between the state of alarm and the state of emergency and siege are analysed, as well as the consequences of the state of alarm and its extensions at the legal level. Finally, a distinction is made between limitation, suspension and prohibition, as well as the affectation caused by the restrictions and possible limitations on the fundamental rights contained in our Constitution
