    El presente estudio tiene como objetivo determinar el alcance actual de un problema de larga data: el desistimiento de la tentativa ante situaciones de multiplicidad de agentes en el hecho punible. La figura de la tentativa, y su reverso, están envueltas en un entramado de problemas de diversa índole. Esta situación se agrava cuando se mantiene un modelo atávico en lo referido a su regulación y tratamiento. De ahí que, con esto, se busca alcanzar, en primer término, un panorama sinóptico de la institución, apreciando críticamente el estado de la cuestión, importando con ello un estudio acabado en la determinación de procedencia de los requisitos, centrándose especialmente en la exigencia de su eficacia. Para la propuesta diferencial, se construye la denominada teoría doble nivel, la cual integra tanto contenidos de lege lata como lege ferenda, por tanto, bajo estructuras híbridas que favorecen el trabajo de determinación.

    The present study aims to determine the current scope of a long-standing problem: the withdrawal of the attempt in situations of multiplicity of agents in the punishable act. The figure of the attempt, and its reverse, are involved in a network of problems of various kinds. This situation is aggravated when an atavistic model is maintained in terms of its regulation and treatment. Hence, with this, it is sought to achieve, in the first place, a synoptic panorama of the institution, critically appreciating the state of the art, thereby importing a thorough study in the determination of the origin of the requirements, focusing especially on the requirement of their effectiveness. For the differential proposal, the so-called double level theory is constructed, which integrates both contents of lege lata as lege ferenda, therefore, under hybrid structures that favor the work of determination.
