La democracia es el contexto necesario, en cuyo defecto mal puede predicarse el respeto y la garantía de los derechos humanos. Todo escrutinio sobre la violación de estos desde la perspectiva de la Convención Americana de Derechos Humanos reclama, así, de una premisa, a saber, la evaluación del marco político institucional dentro del que aquella haya ocurrido. De allí la probable agravación de los efectos que puedan colegirse al momento de ser declarada la responsabilidad internacional de alguno de los Estados parte por hechos internacionalmente ilícitos contrarios a la Convención. Es lo que puede denominarse el control democrático de convencionalidad y que han de ejercer en línea bidireccional sean los jueces nacionales como los de la Corte Interamericana de Derechos Humanos en el plano supranacional. Pero cabe, además, otro control, el de convencionalidad de la democracia cuando se relaciona la violación de los derechos reconocidos por la propia Convención y/o se fijan sus límites respectivos con iguales violaciones de los elementos esenciales y componentes fundamentales de la misma democracia, acudiéndose para ello a las previsiones de la Carta Democrática Interamericana e invocando el artículo 29 sobre las reglas para su interpretación.

Democracy is the necessary context in whose absence the respect and guarantee of human rights can hardly be preached. All scrutiny of the violation of these from the perspective of the American Convention on Human Rights thus demands a premise, namely, the evaluation of the institutional political framework within which it has occurred. Hence the probable aggravation of the effects that may be inferred when the international responsibility of any of the States parties for internationally wrongful acts contrary to the Convention is declared. It is what can be called the democratic control of conventionality and that national judges such as those of the Inter-American Court of Human Rights at the supranational level must exercise in a bidirectional line. But there is also another control, that of the conventionality of democracy when the violation of the rights recognized by the Convention itself is related and / or its respective limits are set with the same violations of the essential elements and fundamental components of the same democracy, resorting to the provisions of the Inter-American Democratic Charter and invoking Article 29 on the rules for its interpretation.
