La fundamentación de la pena ha sido uno de los temas más discutidos en materia de Derecho Penal, por filósofos y juristas en el transcurso de la historia. La importancia de determinar su fundamento radica en la necesidad de justificar su uso, para evitar que parezca un acto arbitrario por parte del estado en uso del lus Puniendi y evitar así una crisis que pueda llevar, en última instancia, a la disolución del estado por una desaprobación general de sus hab1tantes o a una suerte de “Régimen del Terror” como el ocurrido entre 1793 — 1794 en Francia.
En la actualidad, bajo el sistema liberal y un modo de gobierno de ideología demócrata social, se fundamenta la pena a través de la llamada teoría Mixta o Unitaria, que sostiene que “la pena debe reprimir tomando en cuenta la culpabilidad y la proporcionalidad con respecto al hecho delictivo y a la vez prevenir la comisión de nuevos delitos” de este modo se logra un balance entre las dos teorías preponderantes en materia de doctrina penal, las Teorías Absolutas y las Teorías Relativas.

The foundation of the penalty has been one of the most discussed topics in Criminal Law, by philosophers and jurists throughout history. The importance of determining its foundation lies in the need to justify its use, to prevent it from appearing an arbitrary act on the part of the state in use of the lus Puniendi and thus avoid a crisis that could ultimately lead to the dissolution of the state by a general disapproval of its inhabitants or a kind of "Regime of Terror" like the one that occurred between 1793 - 1794 in France.
At present, under the liberal system and a mode of government of social democratic ideology, the penalty is based on the so-called Mixed or Unitary theory, which maintains that "the penalty must repress taking into account guilt and proportionality with respect to to the criminal act and at the same time prevent the commission of new crimes" in this way a balance is achieved between the two preponderant theories in criminal doctrine, the Absolute Theories and the Relative Theories.
