Bicentenario y gobernabilidad: ¿Asamblea Constituyente o reforma constitucional?

    En el marco de las recientes elecciones generales y en el contexto de la conmemoración del bicentenario de la República, se ha producido un intenso debate jurídico y político entre los partidarios de avanzar hacia una Asamblea Constituyente que renueve íntegramente la carta fundamental, y los defensores de introducir reformas parciales a la vigente Constitución de 1993 a través de los mecanismos establecidos en esta para tal fin. El presente artículo explora las ventajas, las limitaciones y los peligros de ambas vías. Del mismo modo, propone un conjunto de reformas constitucionales teniendo siempre como objetivo la necesidad de conservar las condiciones esenciales para la gobernabilidad democrática y el fortalecimiento de los derechos fundamentales en el Perú del siglo XXI.

    In the framework of the recent general elections and in the context of the commemoration of the bicentennial of the Republic, there has been an intense legal and political debate among those in favor of moving towards a Constituent Assembly that fully renews the fundamental charter; and the defenders of introducing partial reforms to the current Constitution of 1993 through the mechanisms established therein for this purpose. This article explores the advantages, limitations and dangers of both routes. In the same way, it proposes a set of constitutional reforms always having as its objective the need to preserve the essential conditions for democratic governance and the strengthening of fundamental rights in Peru in the 21st century.
