Resumen de La maternidad subrogada en la reproducción humana asistida

En el presente artículo la autora expone la problemática jurídica de la maternidad subrogada en la reproducción humana asistida. Evidencia, así, la insuficiencia de normatividad peruana para enfrentar esta realidad permitida por la biotecnología. Al respecto, realiza un análisis de la normatividad sobre la materia, así como de algunas sentencias de casación de la Corte Suprema de Justicia y de las iniciativas legislativas presentadas en el Congreso de la República sobre la maternidad subrogada.

In this article, the author discusses the legal problems of surrogate motherhood in assisted human reproduction. Thus, she evidences the insufficiency of Peruvian regulations to face this reality allowed by biotechnology. In this regard, she analyzes the regulations on the subject, as well as some cassation judgments of the Supreme Court of Justice and the legislative initiatives presented in the Congress of the Republic on surrogate motherhood.
