    Si desde el punto de vista formal y material una ley estuviera bien elaborada, su aplicación se tornaría pronto en eficaz y de esa manera aquella norma jurídica podría liberarse de los consabidos problemas que acarrea la interpretación. La interpretación constitucional configura todos los aspectos en donde la ley, por el contrario, cuando se torna en ambigua e imprecisa resulta entonces imperativo su interpretación. La interpretación constitucional si bien admite el ficcionismo que trasunta el positivismo, no deja por ello que la actividad judicial quede exonerada de realizar actividad interpretativa en el momento en que la ley muestra flaquezas por su generalidad e imprecisión. En el presente ensayo, valiéndose de un territorio poblado de tópicos y de renovadas argumentaciones basadas en principios, se le ofrece al lector pautas de control de la labor que debería realizar el juez, exigiéndole un conocimiento que pueda limitar su subjetividad a fin de brindarle mayor certeza a su decisión. De allí la importancia de la interpretación constitucional que busca hallar soluciones a cuestiones concretas mediante el empleo de un repertorio de los topoi revelados por la propia experiencia judicial.

    If, from the formal and material point of view, a law was well drafted, its application would soon become effective and in that way the legal rule could be freed from the usual problems of interpretation. The constitutional interpretation configures all aspects where the law, on the other hand, when it becomes ambiguous and imprecise, then its interpretation becomes imperative. The constitutional interpretation, although it admits the fictionism that transposes the positivism, does not leave for that reason that the judicial activity is exempted of performing interpretative activity at the moment in which the law shows flaquezas by its generality and imprecision. In this essay, using a territory populated with topics and renewed arguments based on principles, the reader is offered guidelines to control the work that should be done by the judge, demanding knowledge that may limit his subjectivity in order to give him greater certainty to your decision. Hence the importance of constitutional interpretation that seeks to find solutions to specific issues through the use of a repertoire of topoi revealed by judicial experience.
