El Estatuto de Roma cumple 25 años este 2023. Sin embargo, aún no resulta claro si medidas como las amnistías o los indultos tienen o no cabida, y hasta qué punto, bajo aquel. Esto cobra una especial relevancia en el ámbito de la denominada justicia transicional, donde, en ocasiones, los Estados renuncian en todo o en parte a la imposición y/o ejecución de la pena respecto de delitos especialmente graves. El objetivo del artículo es analizar la potencial admisibilidad de las medidas adoptadas en dichos procesos, en el marco de la actuación de la Corte Penal Internacional.
The Rome Statute of the International Criminal Court was adopted 25 years ago. However, it´s still not clear if measures like amnesties or pardons are allowed or not under the Statute. This is a core question in relation to the so-called transitional justice scenarios, in which the States (sometimes) waive the enforcement and/or execution of the penalty for the most serious crimes. The objective of this article is to examine the admissibility (or the lack thereof) of the rewarding measures in the framework of the ICC as the body responsible for ensuring that the most serious crimes against the international community do not go unpunished.
