¿El derecho penal como derecho común? En búsqueda de la naturaleza jurídica de la multa contractual, en sede administrativa

    El presente trabajo se ocupa de la potestad sancionadora de la administración, en términos de distinguir las diversas formas que la doctrina y jurisprudencia entienden el fundamento matriz que le da sentido, examinando las diversas teorías sustentadas por el Tribunal Constitucional chileno. Examinando la reciente interpretación que esa jurisdicción constitucional ha desarrollado en el tiempo reciente, revalorizando la inteligencia de la potestad sancionatoria a la luz del Derecho de la Administración. De otra parte, se presenta la manera como se han resuelto las sanciones contractuales en sede administrativa y la necesidad de una reconfiguración de su comprensión, a partir de la satisfacción del interés general, resignificando la utilización de herramientas propias del derecho administrativo para la reconducción de las conductas infraccionales, en el ámbito de la contratación administrativa.

    This work deals with the sanctioning power of the administration, in terms of distinguishing the various ways that doctrine and jurisprudence understand the matrix foundation that gives it meaning, examining the various theories supported by the Chilean Constitutional Court. Examining the recent interpretation that this constitutional jurisdiction has developed in recent times, revaluing the intelligence of the sanctioning power in light of Administration Law. On the other hand, the way in which contractual sanctions have been resolved at administrative headquarters and the need for a reconfiguration of their understanding based on the satisfaction of the general interest is presented, redefining the use of administrative law tools for the redirection of Infractional conduct, in the field of administrative contracting.
