Cinco años del nuevo marco europeo en protección de datos personales en la Guardia Civil

    Tras la aprobación en 2016, por parte de la Unión Europea, del nuevo derecho derivado relativo a la protección de datos personales, la Guardia Civil al igual que el resto de instituciones, organizaciones, empresas, etc., ha tenido que adaptar los tratamientos que estaba llevando a efecto al nuevo modelo. Este modelo, resulta mucho más exigente hacia quien trata los datos, al depositar la exigencia en el responsable o encargado de tratamiento, no solo de cumplirlo, sino de ser capaz de demostrarlo. A la vez, se ha creado la figura del delegado de Protección de Datos, este con un perfil jurídico, debe actuar con independencia, asesorando y supervisando el cumplimiento por parte de los tratamientos del marco jurídico.

    La Dirección General de la Guardia Civil, cuenta con 55 tratamientos de datos declarados, tanto de ámbito administrativo como policial. Su DPD, que recibe anualmente numerosas consultas, reclamaciones, solicitudes de ejercicio de derechos, ha visto como se produce un incremento incesante en cuanto a las tareas que debe atender, lo que sin lugar a dudas refleja el interés de la Sociedad por el respeto al derecho fundamental a la protección de datos personal

The figure of the Data Protection delegate has been created, this with a legal profile, must act independently, advising and supervising compliance by the treatments of the legal framework.

    The General Directorate of the Civil Guard has 55 declared data processing, both administrative and police. Its DPD, which receives numerous queries, claims, and requests for the exercise of rights every year, has seen an incessant increase in the tasks it must attend to, which undoubtedly reflects the Company’s interest in respec- ting the fundamental right to the protection of personal data.
