La sanción administrativa de destitución por error inexcusable vulnera la independencia del juez

    Con la aprobación y vigencia de la Constitución de la República del 2008, se han ejecutado una serie de reformas legales, donde se incluye y es el objeto de nuestro trabajo, la sanción disciplinaria de destitución al juez por incurrir en error inexcusable contemplado en el artículo ciento nueve numeral siete del Código Orgánico de la Función Judicial, es decir, cometer el juez falta gravísima en el cumplimiento de su deber a través de sus actuaciones en la tramitación y resolución final de una causa que conoce. Se emplearon métodos la revisión bibliográfica, el hermenéutico y el Derecho comparado.Palabras clave: Error inexcusable, independencia, administración, justicia, sanción.

    With the approval and validity of the Constitution of the Republic of 2008, a series of legal reforms have been executed, which includes and is the object of our work, the disciplinary sanction of dismissal to the judge for incurring in inexcusable error contemplated in the article One hundred and nine numeral seven of the Organic Code of the Judicial Function, that is, committing the judge is extremely serious in the performance of his duty through his actions in the processing and final resolution of a case he knows. Methods of literature review, hermeneutics and comparative law were used.Keywords:Unexcused error, independence, administration, justice, sanction.
