Resumen de Materias transigibles en mediación en el Ecuador

  El presente artículo responde a la recurrente pregunta que realizan los mediadores sobre qué materias se pueden mediar en el Ecuador. Para responder esta pregunta se aplicó el enfoque metodológico cualitativo y los métodos analítico-sintético, deductivo y la técnica de revisión bibliográfica. Los resultados obtenidos dan cuenta que actualmente el criterio objetivo general para establecer las materias mediables entre particulares sería que no esté prohibida por la ley; mientras que cuando existe una parte del sector público solo se podrían mediar aquellas materias autorizadas expresamente por la ley. Estos criterios no están exceptos de polémicas, limitaciones y contradicciones debido al mandato constitucional y legal que solo se pueden mediar materias transigibles, lo que hace necesario la búsqueda de criterios propios para la mediación y su separación definitiva de la transacción por ser instituciones jurídicas diferentes.

  This article responds to the recurring question that mediators ask about what matters can be mediated in Ecuador. To answer this question, the qualitative methodological approach and the analytical-synthetic and deductive methods and the bibliographic review technique were applied. The results obtained show that the general criteria to establish mediatable matters between individuals would be all except those expressly prohibited by law; while when there is a part of the public sector, only those matters expressly authorized by law could be mediated. These criteria are not exempt from controversies, limitations and contradictions due to the constitutional and legal mandate that only transigible matters can be mediated, which makes it necessary to search for their own criteria for mediation and their definitive separation from the transaction because they are different legal institutions.
