La evolución de la libertad testamentaria en Derecho Romano trajo consigo, en el marco del testamentum per aes et libram, una amplia libertad para legar que en ocasiones chocaba con los intereses del heredero. Esta realidad justificará la aparición de leges publicae orientadas a limitar la libertas legandi del testador.

he evolution of testamentary freedom in Roman Law brought with it, within the framework of the testamentum per aes et libram, a broad freedom to bequeath that sometimes conflicted with the interests of the heir.
