    En cualquier organización social encontramos realidades objetivas que están afectadas a su existir y desarrollo. Al mismo tiempo, encontramos realidades que pertenecen individualmente a cada uno de sus miembros. Todas ellas exigen del grupo una regulación jurídica cuya manifestación será acorde con la estructura de la comunidad concreta en la que se circunscriben. En el marco de la familia anterior a la formación urbana romana la mayoría de las cosas son colectivas y están destinadas a todos los integrantes del grupo, no obstante, la figura del jefe de familia se configura como elemento vertebrador y controlador de todo lo material relativo a la comunidad familiar.

    In any social organization we find objective realities that are affected by its existence and development. At the same time, we find realities that belong individually to each member. All of them require from the group a legal regulation whose manifestation will be in accordance with the structure of the specific community in which they are confined. In the framework of the family prior to roman urban formation, most things are collective and are intended for the group, although the head of the family is configured as the structurer and controller of all material matters related to the family community.
