Este trabajo analiza los vicios constitucionales, procesales y tributarios que afectan a las sentencias de la Sala Constitucional del Tribunal Supremo de Justicia números 0078 y 0118, a través de la cuales dicho tribunal, sin tener competência para ello, suspendió temporalmente el ejercicio del poder tributario de los municipios e impuso a éstos la obligación de suscribir un acuerdo de armonización de las tarifas de sus impuestos y tasas, bajo la coordinación del Poder Ejecutivo y sin respetar las regulaciones constitucionales sobre armonización tributaria.
This work analyzes the constitutional, procedural and tax flaws that affect the sentences of the Constitutional Chamber of the Supreme Court of Justice numbers 0078 and 0118, through which said court, without having jurisdiction to do so, temporarily suspended the exercise of the tax power of the municipalities and imposed on them the obligation to sign an agreement to harmonize the rates of their taxes and fees, under the coordination of the Executive Power and without respecting the constitutional regulations on tax harmonization.
