Resumen de Codificación en el derecho de trabajo actual y el derecho de los trabajadores migrantes en el Ecuador

La investigación va dirigida al estudio de la codificación del trabajo en Ecuador y la importancia de dichas leyes en el trabajador extranjero «migrante». Lo relevante que resulta revisar y analizar la Constitución y todas las Leyes supletorias referente al derecho laboral, que necesitan conocer tanto los trabajadores ecuatorianos como los extranjeros, así como también, los empleadores. De esta forma evitar sanciones, multas y violación de derechos por parte de la persona que realiza la contraprestación de servicios. Es una investigación documental, analítica, descriptiva y cualitativa, resaltando las teorías y antecedentes de varios autores y las leyes que tienen relación con el estudio. Se determina en primer lugar, la importancia de la igualdad del trabajador, sin importar su estatus de migrante o no. En segundo lugar, la situación actual y futura del derecho del trabajo en el Ecuador. Y en tercer lugar, la adaptación de temas internacionales que forman parte de la integridad del trabajador extranjero. Finalmente, se presenta un acuerdo emitido por el Ministerio del Trabajo del Ecuador, donde se marcan pautas importantes para el manejo adecuado de los trabajadores migrantes y, al mismo tiempo, mantenerse al día con todos los deberes que exige la legislación en materia de derecho laboral.

The research is aimed at the study of coding work in Ecuador and the importance of such laws in the «migrant» foreign. The relevant resulting review and analyze the Constitution and all laws additional relating to labor law, who need to know both Ecuadorian workers and foreigners, as well as employers. Thus avoid sanctions, fines, and violation of rights by the person making the consideration of services. It is a research documentary, analytical, descriptive and qualitative, emphasizing theories and history of several authors and the laws relating to the study. It is determined in the first place, the importance of the equality of the worker, regardless of their migrant status or not. Secondly, the current and future situation of the right to work in Ecuador. And thirdly, adaptation of international issues that are part of the integrity of the foreign worker. Finally, presented an agreement issued by the Ministry of the work of the Ecuador, where are marked important guidelines for the proper handling of migrant workers and, at the same time, keep abreast with all the duties required by the legislation of labor law.
