El presente trabajo pretende centrarse en el análisis y estudio de los artículos de la Ley Trans española, recientemente aprobada, que se dedican al ámbito educativo y pueden vulnerar el derecho constitucional y convencional de los padres, a elegir la formación religiosa y moral de sus hijos, según sus propias convicciones. Ante esta percepción de vulneración de derechos, analizaremos la posibilidad de que los padres y los docentes invoquen objeción de conciencia, en relación con determinados contenidos educativos que puedan resultar incompatibles respecto a sus más profundas convicciones religiosas.
The present paper aims to focus on the analysis and study of the articles of recently passed Spanish Trans Act who are dedicated to the educational field and might violate the constitutional and conventional right of parents, to choose the religious and ethical formation for their sons, according to their own convictions. In light of this perceived violation of rights, we'll analyze the possibility of parents and teachers to invoke conscientious objection, in relation to the changes in educational contents that might result incompatibility regarding their deepest religious convictions.
