El interés superior del menor como eje vertebrador de la futura regulación de la gestación por sustitución solidaria en España

    La legalización de la gestación subrogada en diferentes países ha suscitado un intenso debate jurídico-constitucional. En España auguramos que llegará a ser legitimada a medio plazo, al menos con carácter altruista, porque no puede obviarse que la gestación por sustitución viene teniendo lugar fuera de nuestras fronteras y ante este hecho el legislador deberá empezar a solucionar las implicaciones jurídicas que tal forma de reproducirse genera, una vez constatada la obsolescencia del principio mater semper certa est. Ante ese futuro escenario, el propósito del presente trabajo es reflexionar en torno a los derechos dignos de protección del menor que nace de este proceso reproductivo y su interés superior, al ser la piedra angular de la futura regulación en la materia, pues desde esa perspectiva se podrán garantizar tanto los derechos fundamentales de la mujer gestante como los de los progenitores de intención.

    The legalization of surrogacy in different countries has sparked an intense legal-constitutional debate. In Spain we predict that it will become legitimized in the medium term, at least altruistically, because it cannot be ignored that surrogacy has been taking place outside our borders and in view of this fact the legislator must begin to solve the legal implications that such a way of reproducing generates, once the obsolescence of the mater semper certa est principle has been verified. Faced with this future scenario, the purpose of this paper is to reflect on the rights worthy of protection of the minor who is born from this reproductive process and their best interest, as it is the cornerstone of future regulation on the matter, since from that perspective both the fundamental rights of the pregnant woman and those of the intended parents can be guaranteed.
