    El Centro Internacional de Arbitraje de Madrid (CIAM) ha aprobado el pasado día 19 de octubre de 2023 su nuevo Reglamento de Arbitraje, que entrará en vigor el próximo 1 de enero de 2024, en el que incluye una novedosa regulación relativa a la impugnación opcional del laudo.

    Este procedimiento permite a las partes someter el laudo, una vez realizado el escrutinio previo del Centro, al análisis de un nuevo Tribunal Arbitral que se pronunciará exclusivamente sobre la existencia de una infracción manifiesta de las normas jurídicas sustantivas aplicables al fondo de la controversia o de un error manifiesto en la apreciación de los hechos que han servido de base para la decisión.

    The Madrid International Arbitration Center-CIAM has approved, on October 19, 2023, its new Arbitration Rules, which will enter into force on January 1, 2024, including a novel regulation on the optional challenge of the award.

    This procedure allows the parties to submit the award, once it has been previously examined by the Center, to the analysis of a new arbitral tribunal that will rule exclusively on the existence of a manifest violation of the substantive rules of law applicable to the merits of the dispute or of a manifest error in the assessment of the facts that have served as the basis for the decision.
